How to File an EEOC Complaint

To file an EEOC complaint: (1) Contact the EEOC within 180 days of the discriminatory act (300 days in states with their own anti-discrimination agency). (2) File a charge online, by mail, or in person at an EEOC office.

(3) The EEOC will notify your employer and may investigate or attempt mediation. (4) If the EEOC closes your case, you'll receive a 'right to sue' letter allowing you to file a lawsuit.

The EEOC process is required before filing most federal discrimination lawsuits. State claims may have different procedures..
